Atmore man jailed for murder

Dale had a history of abuse charges against victim; ordered to have no contact with her

An Atmore man who was under a protection from abuse order following several domestic violence arrests was arrested Monday, May 27, and charged with murder for the shotgun slaying of the woman he was ordered to stay away from.

Fred Dale, Jr., 61, 151 Terrace St., was taken into custody without incident following the shooting death of Cynthia Dale and transported to the Escambia County Detention Center in Brewton and is being held without bond. Escambia County District Judge Eric Coale has set an Anya's Law hearing for 2 p.m. today (Thursday) to determine if Dale is entitled to a bond.

Atmore police reported that on May 27 about 4:05 a.m. police responded to the100 block of Terrace Street in reference to a domestic related shooting.

Court records stated Cynthia Dale was shot to death with a shotgun.

Court records also show Fred Dale had been arrested and convicted several times in the past on domestic violence charges against Cynthia Dale.

On Aug. 30, 2000, former Circuit Judge Bradley Byrne approved a petition for protection of abuse filed by Cynthia Dale against Fred Dale and Fred Dale was still under that order when Monday's shooting occurred.

In that order, Judge Byrne ordered Fred Dale not to threaten or commit any acts of abuse toward Cynthia Dale and Fred Dale was prohibited from harassing, annoying, telephoning, contacting or communicating directly or indirectly with Cynthia Dale and minor children.

Fred Dale was also ordered to stay away from the residence, school or place of employment of Cynthia Dale, the minor children or any specified place frequented by Cynthia Dale or the minor children.

Cynthia Dale was also awarded custody of the children and Fred Dale was ordered to vacate the residence of Cynthia Dale.

Records also indicate Fred Dale was charged with domestic violence III the day before Judge Byrne issued his 2000 order and for violation of the protection order the day the protection order was signed.

Fred Dale was arrested again in 2001 for domestic violence III assault against Cynthia Dale but that case was nol prossed on an order by then District Judge Gordon Batson.
