Daw is jailed for assault

Alleged victim in shooting arrested in steel pipe attack

The alleged victim of a Dec. 24 shooting on Jack Springs Road has been arrested and charged with assault II for allegedly hitting the shooting suspect in the head with a steel pipe the day before the shooting incident.

Rody Lee Daw, 39, 9941 Gantt Road, Red Level, was jailed on $2,000 on the assault charge.

Escambia County (Ala.) Sheriff’s Office deputies originally responded to a shots fired call at 7400 Jack Springs Road on Dec. 24. Dakota Loren Harmon, 25, with addresses listed as Old Highway 31, Lot 13, Brewton, and 7400 Jack Springs Road, Atmore, was later arrested and charged with shooting into an unoccupied vehicle.

Reports stated that Harmon allegedly fired a shotgun loaded with birdshot in the direction of Daw, striking the vehicle.

Deputies initiated a traffic stop and deputies removed Harmon and the driver of the vehicle, Tessa Elizabeth McClure, 21, 1819 College St., Flomaton. Reports state Harmon told deputies the gun used was in the trunk of the car and it was self defense.

Deputies learned that Harmon had a warrant for his arrest with the Bay Minette Police Department and he was taken into custody. A search of the trunk also revealed a bag containing a crystalized substance that tested positive for methamphetamine. Officers also found a green leafy material that was confirmed to be synthetic cannabinoids (spice), a torch lighter, a modified paper clip used as a scraper, a burned glass pipe that contained drug residue and rolling papers.

Harmon and McClure were both charged with unlawful possession of a controlled substance and Harmon was charged with shooting into the vehicle. Both were transported to the Escambia County Detention Center in Brewton.

Court records also show that Daw allegedly struck Harmon with the steel pipe on Dec. 23. Harmon was transported to Atmore Community Hospital where he was treated and released. Daw was later arrested and charged with assault II.
