Two Brewton men arrested on sexual charges, one felony

A Brewton man accused of sexual assault by a juvenile female was arrested Wednesday and admitted to law enforcement that the accusation was true.

Walter James Nearer, 71, 101 Payne St., admitted to investigators that he had consumed a few drinks before he sucked on a juvenile female's toes and breast after giving her $5.

The confession came after law enforcement responded to to a call on or about July 1 through July 31 about a sexual assault by an elderly man on a juvenile female.

The female victim was sent to Child Advocacy Center in Covington where she was given a forensic interview to get her story.

After the female was interviewed, law enforcement interviewed the suspect. Nearer admitted to investigators that he had done it after he had a few drinks. Corporal Hodges with the Brewton police said the suspect told investigators that if he needed to go to jail because of this, he would, because he did commit this crime.

Nearer was arrested and charged with sexual abuse II and transported to the Escambia County Detention Center and given a bond of $2,500.

Felony

A Brewton man is facing a felony rape charge after the victim picked him out of a photo lineup and investigators were able to match him up to a name found in their criminal data base based on the victim’s description of the suspect.

James Exel Hendrieth, 39, 67 Maddox Loop, was arrested Wednesday and charged with felony rape II after a 50-year-old female identified the suspect from a photo lineup and accurately described to investigators his face tattoos and nickname.

On Oct. 24, Brewton police received a call from the Forest Avenue in Brewton area pertaining to a rape situation. According to Corporal Hodges with the Brewton police, when an investigator made contact with the victim, she walked him though the scene. The victim began to identify the suspect and described a black male with tattoos on his face going by the nickname “Deer”. The victim was transported to the hospital for treatment.

When investigators searched their data base with the nickname and tattoos the victim described, they found a match. The suspect's photo was put in photo lineup and the victim picked him out.

Hodges said when suspect Hendrieth was interviewed, he admitted he had sex with the victim, but said it was consensual. Hendrieth told investigators the victim came onto him and that the rape accusation was false.

Hendrieth was arrested and charged with one count felony rape II and transported to the Escambia County Detention Center, where he awaits bond.
