Two Brewton men jailed for having sex with 12 and 14 year olds; more charges coming

An East Brewton woman is currently facing six counts of rape II and more charges are expected after being accused of allowing adult males to have sexual intercourse with her two daughters, ages 12 and 14.

Kimberly Kelley, 210 Ball Lane, Lot No. 32, appeared before Escambia County District Judge Jeff White on her 46th birthday Tuesday where she received a $500,000 bond.

Two Brewton men accused of having sex with the underage girls received bonds of $250,000 each.

Davely Miller, 20, 119 East Rankin St., and Marcus D. Paul, 19, 67 Maddox Loop, are both charged with two counts of rape II for allegedly having sex with Kelley's daughters.

In addition to the rape II charges, Kelley faces two misdemeanor charges for failing to register her children in school.

During Tuesday's bond hearing, Assistant District Attorney Kim Pettis told Judge White that the case will involve multiple jurisdictions including Conecuh County and the city of Brewton that included men as old as 43 having sex with the young girls.

Pettis said with the nature of the crime of a mother facilitating the relationships between her juvenile daughters and adult men she requested the $500,000 bond, to which Judge White agreed.

During the bond hearing, Kelley first told Judge White that she had no prior felony convictions but later admitted she had been convicted on a felony drug charge 20 years ago.

East Brewton Police Chief Kenny Brazille said police officers were investigating another case and were talking to people in the trailer park where Kelley lived which prompted the investigation into Kelley.

Brazille said residents were concerned that the young girls were not in school and told officers they felt "inappropriate" things were going on inside the mobile home.

Brazille said contact with the Department of Human Resources revealed DHR had previous involvement in that home.

"Finally people said something that meant something and we started the investigative process then," Brazille said.

He said they learned the case crossed four jurisdictions and expects more arrests.

"She knew boys were staying in the home with underage girls," Brazille said. "She was allowing 18 year olds to sleep with a 12-year old."

Brazille said following the investigation he was able to obtain arrest warrants for Kelley, Paul and Miller. He said Kelley and Paul were arrested Monday in the same vehicle. Miller turned himself in later that day.

Brazille said in addition to possible charges in Brewton and Conecuh County, his office is continuing its investigation into possible more suspects in East Brewton. He did note one 16-year old juvenile has also been charged with having sex with the 12-year old.
